WILL I GET BAIL ?

When a person is arrested in Virginia, and then taken to the local jail. One of three things can happen. An unsecured bond is given which means the person can sign themselves out of jail. No bond is given so the person can’t leave jail. Or a secured bond is given. That’s when you should call us. While we can’t give legal advice, we can explain all of your options and answer any questions you have.

How does the bail process work?

First, we’ll call the jail and get things started. While we can get the process started, we can’t post the bond until they’re booked into jail. That process can take a couple hours due to jail policies and schedules. But while you’re waiting, you can also feel better, knowing you have a reliable bail company working for you.

How much will I pay for bond?

Do I get my money back after the defendant goes to court?

When the bail bond has served its purpose, the bondsman will be exonerated (i.e., released from the obligation). Exoneration normally occurs when the proceeding is terminated in some way or on the return of the defendant to custody. After conviction, the defendant appears for sentence. If sentenced to imprisonment the defendant is committed to the custody of the sheriff, and the liability of the bondsman terminates. You will not receive any money back that you have paid the bail bondsman.

What if the charges are dismissed?

Statutes provide for exoneration of the bondsman in the event of dismissal. However, there is usually a time period within which the prosecuting agency may seek to re-arrest and charge with a public offense arising out of the same act or omission upon which the action or proceeding was based. You will not receive any money back from the bail bond company.
